1. Scope
   For all orders placed via our website, the following General Terms and Conditions (GTC) apply. The offer on this website is aimed exclusively at consumers with residence in Switzerland (hereinafter “customer”).

A consumer is a natural person who maintains business relations with MajesticArt KLG (majesticart.ch) that cannot be assigned to their commercial or independent professional activity. Orders in non-household quantities may be rejected without stating reasons.

MajesticArt KLG (majesticart.ch) reserves the right to change these GTC at any time. The version of these GTC applicable at the time of the order is decisive and cannot be unilaterally changed for this order. Opposing or deviating terms and conditions of the customer are not recognized.

1. Prices
   The sales prices stated on MajesticArt KLG (majesticart.ch) are final prices and include, unless otherwise noted, the statutory value added tax and any other statutory charges such as advance recycling fees (VRG) or copyright levies for electronic devices. Prices are net in Swiss francs (CHF).

Any shipping costs will, unless otherwise provided, be charged additionally and are to be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints are reserved; in particular, MajesticArt KLG (majesticart.ch) may make price changes at any time and without prior notice. Advisory and support services are not included in the sales prices.

1. Conclusion of contract
   The products and prices on this website are to be understood as non-binding offers.

By ordering via this website, including accepting these GTC, the customer submits a legally binding offer to conclude a contract. MajesticArt KLG (majesticart.ch) then sends an automatic order confirmation by email, which confirms that the customer’s offer has been received by MajesticArt KLG (majesticart.ch). Orders placed are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.

The contract is concluded as soon as MajesticArt KLG (majesticart.ch) sends an acceptance declaration by email confirming the dispatch of the ordered products or services.

Orders are delivered only after full receipt of payment (exception: delivery on account) and provided the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, MajesticArt KLG (majesticart.ch) is entitled not to accept the order or to accept/execute it only in part. In such a case, MajesticArt KLG (majesticart.ch) will inform the customer by email. If the customer’s payment has already been received by MajesticArt KLG (majesticart.ch), the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the payment obligation.

1. Payment options and retention of title
   The customer has the payment options indicated in the ordering process at their disposal.

MajesticArt KLG (majesticart.ch) reserves the right to exclude customers from individual payment options without stating reasons or to insist on advance payment.

In the event of late payment by the customer, MajesticArt KLG (majesticart.ch) may charge default interest of 5% per year as well as a reminder fee of a maximum of CHF 20.- per reminder.

The products delivered to the customer remain the property of MajesticArt KLG (majesticart.ch) until full payment has been made.

1. Delivery, duty to inspect, notice of defects and returns
   Deliveries are sent by post or courier service to the address specified by the customer in the order.

MajesticArt KLG (majesticart.ch) endeavors to keep delivery times as short as possible. However, any delivery periods stated in the order confirmation are non-binding. MajesticArt KLG (majesticart.ch) is entitled to make partial deliveries. In this case, shipping costs will only be charged to the customer once.

The invoice, insofar as delivery on account is offered, is sent at the discretion of MajesticArt KLG (majesticart.ch) by email or by post.

If the delivery is not deliverable or the customer refuses to accept the delivery, MajesticArt KLG (majesticart.ch) may dissolve the contract after notifying the customer by email and allowing a reasonable grace period, and charge the costs for the efforts incurred.

The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which MajesticArt KLG (majesticart.ch) provides a warranty without delay in writing by letter or email to the address in the imprint (>Link).

Returns to MajesticArt KLG (majesticart.ch) are at the customer’s expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address specified by MajesticArt KLG (majesticart.ch) in the imprint (>Link).

If, upon inspection by MajesticArt KLG (majesticart.ch), it is found that the goods have no detectable defects or that these are not covered by the manufacturer’s warranty, MajesticArt KLG (majesticart.ch) may charge the customer for the efforts, the return shipment or any disposal.

1. Right of withdrawal
   The customer is granted a right of withdrawal for 14 calendar days after receipt of the goods. The deadline is deemed met if the customer sends the written withdrawal by email or letter (MajesticArt KLG, P.O. Box, 8180 Bülach, >Link) to MajesticArt KLG (majesticart.ch) within the period. No justification is required for the withdrawal.

Exercising the right of withdrawal leads to a rescission of the contract. The customer must return the goods within 14 calendar days in their original packaging, complete with all accessories and together with the delivery note to the return address specified by MajesticArt KLG (majesticart.ch) in the imprint (>Link). Returns to MajesticArt KLG (majesticart.ch) are at the customer’s expense and risk. Any payment already made will be refunded to the customer within 30 calendar days, provided that MajesticArt KLG (majesticart.ch) has already received the goods or the customer can provide proof of shipment.

MajesticArt KLG (majesticart.ch) reserves the right to demand reasonable compensation for damages, excessive wear or loss of value due to improper handling and to deduct the depreciation from the purchase price already paid or to charge the customer.

In the following cases, no right of withdrawal is granted:

If the contract has an element of chance, in particular because the price is subject to fluctuations over which the provider has no influence;
If the contract concerns a movable item which, due to its nature, is not suitable for return or can quickly perish;
If the contract concerns a movable item which is manufactured according to the customer’s specifications or is clearly tailored to personal needs;
If the contract concerns digital content and these contents are not provided on a tangible data carrier or if the contract is to be fully performed by both contracting parties immediately;
If the contract concerns a service and the contract is to be fully performed by the provider with the prior express consent of the customer before the withdrawal period has expired.
In the areas of accommodation, transportation, delivery of food and beverages, and leisure activities, when the provider undertakes at the conclusion of the contract to provide the services at a specific time or within a precisely specified period.

1. Warranty
   MajesticArt KLG (majesticart.ch) endeavors to deliver goods of impeccable quality. In the case of defects notified in due time, MajesticArt KLG (majesticart.ch) assumes the warranty for freedom from defects and functionality of the item purchased by the customer during the statutory warranty period, which is generally two years from the delivery date. It is at the discretion of MajesticArt KLG (majesticart.ch) Preises zu erbringen. Further warranty rights are excluded.

Normal wear and tear, as well as the consequences of improper handling or damage by the customer or third parties, and defects due to external circumstances are not covered by the warranty. The warranty is also excluded for consumables and wear parts (e.g., batteries, rechargeable batteries, etc.).

It is not possible for MajesticArt KLG (majesticart.ch) to make assurances or guarantees for the timeliness, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and other content. 1. Liability
   MajesticArt KLG (majesticart.ch) excludes any liability, regardless of its legal basis, as well as claims for damages against MajesticArt KLG (majesticart.ch) and against any auxiliary persons and agents. In particular, MajesticArt KLG (majesticart.ch) is not liable for indirect damages and consequential damages, lost profit or other personal, property and pure financial losses of the customer. A further mandatory statutory liability remains reserved, for example for gross negligence or unlawful intent.

1. Data protection

In the event of disputes, exclusively substantive Swiss law shall apply, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is expressly excluded.
