The security of user data comes first

MajesticArt KLG (majesticart.ch) respects the privacy of all users of the website and/or online shop (hereinafter referred to as “the customer” or “the customers”). This privacy policy forms the basis for the processing of personal data and provides information about which types of user data are collected from customers by MajesticArt KLG (majesticart.ch), how MajesticArt KLG (majesticart.ch) uses these data, and which rights the customers have. MajesticArt KLG (majesticart.ch) complies with the applicable data protection laws and processes personal data solely for the purposes for which the data were transmitted.

This privacy policy is adapted, supplemented, or amended from time to time. With each new access to or visit of the website, the respectively current, retrievable version applies.

If contradictions arise between this privacy policy and other applicable contractual or business terms and conditions of MajesticArt KLG (majesticart.ch), the provisions of this privacy policy shall take precedence.

Type and purpose of the data collected

The term “personal data” or “person-related data” within the meaning of this privacy policy includes information by which customers can be personally identified.

Processing of personal data means any handling of personal data, such as recording, using, storing, disclosing, transmitting, or deleting the data.

MajesticArt KLG (majesticart.ch) collects personal data automatically when the customer interacts with the website or uses the online shop. On the other hand, personal data that a customer provides (e.g., by making contact, creating a user profile or customer account) are collected automatically or manually.

2.1. Data collected automatically

When visiting the website of MajesticArt KLG (majesticart.ch), statistical visitor data are automatically collected about which parts of the web offering the customer visits. Each time a webpage is called up, the web server automatically saves a so-called server log file which, for example, contains the name of the requested file, the customer’s IP address, date and time of the access, the browser used, operating system, amount of data transferred, and the requesting provider (access data), and documents the access. In this context, it is sometimes necessary to use so-called cookies (see section 4 below).

These access data are evaluated exclusively for the purpose of ensuring trouble-free operation of the site as well as improving our offering.

2.2. Data when interacting with MajesticArt KLG (majesticart.ch), for contract processing, contacting us, and when opening a customer account

MajesticArt KLG (majesticart.ch) does not carry out any automatic collection of customers’ personal data such as name, address, telephone number, or email address.

However, personal data of customers are collected when a customer voluntarily provides them as part of an order or when contacting MajesticArt KLG (majesticart.ch) (e.g., via contact form or email). Mandatory fields are marked as such because in these cases MajesticArt KLG (majesticart.ch) necessarily needs the data for contract processing or to handle the contact request, and without their provision the order or the contact request cannot be sent. If a customer decides to open a customer account, MajesticArt KLG (majesticart.ch) uses the personal data for the purpose of opening the customer account. The mandatory information requested during registration must be provided in full; otherwise, MajesticArt KLG (majesticart.ch) can refuse registration. MajesticArt KLG (majesticart.ch) uses the collected personal data only for the purpose of using the online shop or the respective offering or service for which the customer has registered. In addition, MajesticArt KLG (majesticart.ch) can use the customer’s email address to inform them about important changes, such as to the scope of the offering, or about changes that are technically necessary.

After the contract has been fully processed or after deletion of the customer account, the customer’s data are restricted for further processing and deleted after expiry of the tax and commercial law retention periods, provided that the customer has not expressly consented to further use of the data or MajesticArt KLG (majesticart.ch) reserves a further use of the data that is permitted by law. Deletion of the customer account is possible at any time and can be carried out either by a message to the contact details given below (see section 9 below) or via a function provided for this purpose in the customer account.

Legal basis for collecting and processing personal data

The legal basis for collecting and processing the customer’s personal data depends on the specific purpose of the data processing in each individual case. In particular, the following may apply:

the safeguarding of the legitimate interests of MajesticArt KLG (majesticart.ch), provided that the interests of the customer or fundamental rights or freedoms are not unduly affected;

the conclusion or performance of a contract; or

the customer’s consent at the time the personal data are collected. The customer can revoke their consent at any time. For this purpose, the customer can send a corresponding notification to the contact details described below. The lawfulness of data processing already carried out remains unaffected by the revocation.

Use of cookies and use of the data

4.1. Cookies

To continuously improve the web presence for customers, MajesticArt KLG (majesticart.ch) may use cookies. Cookies are small software information items that are stored by web browsers (e.g., Google Chrome, Internet Explorer, or Mozilla Firefox) on the customer’s computer hard drive in order to facilitate the use of the website (e.g., language selection, shopping cart, etc.).

Some of the cookies used by MajesticArt KLG (majesticart.ch) are deleted after the end of the browser session, i.e., after closing the web browser (so-called session cookies). Other cookies remain on the end device and enable MajesticArt KLG (majesticart.ch) to recognize the customer’s web browser on the next visit (so-called persistent cookies). Most web browsers accept such cookies automatically; however, the web browsers can be configured so that they do not accept or store cookies. 4.2. Use of the data

The anonymized data recorded when calling up the MajesticArt KLG (majesticart.ch) website by means of cookies can be used for web analysis purposes, to optimize the website, and to measure performance. For this purpose, MajesticArt KLG (majesticart.ch) can use third-party providers who partially have their own data protection regulations over which MajesticArt KLG (majesticart.ch) has no influence.

Google Analytics

Google evaluates the use of the website in order to compile reports on website activities and to provide further services related to website and internet use to MajesticArt KLG (majesticart.ch). The IP address transmitted by the customer’s web browser within the framework of Google Analytics is not merged with other data by Google.

The information generated by cookies about the use of the website is usually transferred to a server of Google in the USA and stored there. Google observes the data protection provisions of the “Swiss-U.S. Privacy Shield” agreement and has registered with the U.S. Department of Commerce for the “Swiss-U.S. Privacy Shield” (information on the Swiss-U.S. Privacy Shield can be found at https://www.privacyshield.gov/Swiss-US-Privacy-Shield-FAQs).

Google AdWords and Google Conversion Tracking

Provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

As part of Google AdWords, Metaly.ch uses so-called conversion tracking. If the customer clicks on an ad placed by Google, a cookie for conversion tracking is set. These cookies lose their validity at the latest after 30 days and are not used to identify the customer. If the customer visits the website of MajesticArt KLG (majesticart.ch) and the cookie has not yet expired, Google and MajesticArt KLG (majesticart.ch) can recognize that the customer has clicked on the ad and was redirected to this page.

MajesticArt KLG (majesticart.ch) learns from Google the total number of users who clicked on the ad and were redirected to a website provided with a conversion tracking tag. However, MajesticArt KLG (majesticart.ch) does not receive any information that can be used to personally identify the customer.

Google Maps

Provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

MajesticArt KLG (majesticart.ch) uses Google Maps to visually display geographic information. When using Google Maps, Google transmits or processes data about the use of the Maps functions by website visitors, which may include the IP address and location data in particular. MajesticArt KLG (majesticart.ch) has no influence on this data processing.

If information is transferred to servers of Google in the USA and stored there, the American company Google LLC is certified under the “Swiss-U.S. Privacy Shield”.

To deactivate the Google Maps service and thereby prevent the transmission of data to Google, a customer must deactivate the JavaScript function in the web browser. In this case, Google Maps cannot be used or can only be used to a limited extent.

4.3. Social media content

MajesticArt KLG (majesticart.ch) may use social media plugins from social networks on the website, such as Facebook, Instagram, or Twitter.

When the customer accesses a webpage that contains such a plugin, the web browser establishes a direct connection to the servers of the respective social network. The content of the plugin is transmitted directly to the web browser by the respective provider and integrated into the page. By integrating the plugins, the providers receive the information that the customer’s web browser has called up the corresponding webpage of MajesticArt KLG (majesticart.ch), even if the customer does not have a profile with the respective social network or is not currently logged in. This information (including the IP address) is transmitted directly from the customer’s web browser to a server of the respective provider (possibly in the USA) and stored there. If the customer is logged in to one of the services, the providers of the social network can directly assign the visit to the website of MajesticArt KLG (majesticart.ch) to the profile in the respective social network. If the customer interacts with the plugins, for example by pressing the “Like” or “Share” button, the corresponding information is also transmitted directly to a server of the providers and stored there. The information is also published in the social network and displayed to the customer’s contacts there.

These social network platforms have their own data protection regulations over which MajesticArt KLG (majesticart.ch) has no influence.

If the customer wishes none of these plugins to be loaded, it is recommended to log out of the corresponding social networks. Furthermore, various web browsers can be set or supplemented with add-ons (e.g., Facebook Blocker) so that the social media plugins are not loaded.

Newsletter

If the customer would like to subscribe to a newsletter offered by MajesticArt KLG (majesticart.ch, MajesticArt KLG (majesticart.ch) needs the customer’s email address and other information that allows verification that the customer is the owner of the specified email address and agrees to receive the newsletter (so-called “double opt-in” procedure). If the customer, as a registered customer, wishes to register for a newsletter, they can give consent at the time of registration or later via the registration function in the customer account.

With the newsletter, the customer regularly receives recommendations and offers that might interest them. For this purpose, MajesticArt KLG (majesticart.ch) collects and processes personal data regarding the customer’s usage behavior on the website, the orders at MajesticArt KLG (majesticart.ch), as well as how the customer uses the newsletter (e.g., whether the newsletter is opened or which web-URL links are clicked). MajesticArt KLG (majesticart.ch) can evaluate these data for statistical purposes in order to better tailor the content of the newsletters to the interests of customers.

Processing of the personal data entered into the newsletter registration form is based on the customer’s consent, which they can revoke at any time for the future. Revocation is effected either via the “unsubscribe” link in the newsletter, by written notification from the customer to MajesticArt KLG (majesticart.ch) at the address listed below, or by unsubscribing in the customer account. MajesticArt KLG (majesticart.ch) uses the collected personal data for the content design and dispatch of the newsletters. There is no disclosure to third parties for their own (advertising) purposes.

MajesticArt KLG (majesticart.ch) stores the personal data provided by the customer for the purpose of receiving the newsletter until the customer unsubscribes from the newsletter again.

Disclosure of your data

MajesticArt KLG (majesticart.ch) will not disclose customers’ personal data to third parties. The exception is where the customer has consented to the disclosure of the data to companies not affiliated with Metaly.ch or where MajesticArt KLG (majesticart.ch) is legally, administratively, or judicially obliged to do so. Also, where service providers that support MajesticArt KLG (majesticart.ch) in data processing, in the administration of the website, or in another way as well as in the provision of the products and services requested by the customer are engaged (e.g., parcel or newsletter dispatch service providers). These third parties are obliged to observe the same level of security and data protection as MajesticArt KLG (majesticart.ch).

Data security

Unfortunately, the transmission of data over the internet is not absolutely secure. MajesticArt KLG (majesticart.ch) works with service providers and internet providers who take appropriate technical and organizational security precautions to protect customers’ personal data. MajesticArt KLG (majesticart.ch can, however, not guarantee the security of the data transmitted by the customer. Any data transmission therefore takes place at your own risk.

Your rights to information and withdrawal

Of course, every customer is free to inform MajesticArt KLG (majesticart.ch) at any time—for example, in an email—that their personal data should no longer be used for contact purposes in the future. Participation in the special services of the MajesticArt KLG (majesticart.ch) website, such as the newsletter service, can also be revoked at any time.
